How Does the Process Work?
Although you will want to talk to an attorney first, the actual legal process for getting a divorce in Illinois starts with filing the divorce petition. That said, other specific steps that might be required, how long the process may take and how much it could cost will depend on how far apart the two of you are on the major issues.
If the two of you can reach an agreement on all of the major issues (child custody, support, property division and tax issues included) — the entire process can be completed at a greatly reduced cost in as little as a week or two. This is what's known as an uncontested divorce.
If some or all of those issues cannot be resolved, either through the mediation process or with our attorney's help in negotiations — then you have what lawyers call a contested divorce. In these cases (which can take anywhere from six months to several years to resolve), you can depend on us to aggressively protect your interests and seek the most timely, cost-effective results possible under the circumstances.
As part of this process, we also help clients:
- Resolve child custody issues
- Obtain fair child support and alimony terms
- Divide marital property and debts equitably
- Modify custody, visitation or support terms after the divorce
