Where Will My Children Live?
If your custody differences can't be resolved through negotiation or mediation, Illinois courts will consider a number of factors in making a decision about where your child will live and how much visitation the non-custodial parent will have. These include:
- The residential circumstances of each parent
- The wishes of the child
- The interaction and interrelationship of the child with each parent, any siblings and any other person who may significantly affect the child's best interest
- The child's adjustment to his or her home, school and community
- Prior incidents of domestic violence
- The willingness and ability of each parent to facilitate and encourage a close and continuing relationship between the other parent and the child
